G•IPRs News Update - Sept. 2009
On Sept. 28, 2009, G•IPRs Runhe Group, based on H.264 and AVS Standard, launched the establishment of the database for analysis of Patents involved in Standard of Audio Video Coding Standard. At the initial stage, the emphasis of research is put on analyzing the corresponding relationship between the Patents involved in Standard (hereinafter "PIS") and Standard Technology, and the legal status, suits and cases of PIS.
From Sept. 26 to 27, 2009, the 7th Forum of Lawyers in East China, jointly held by the Bar Associations of six provinces and one municipality in east China and taken charge by the Bar Association of Zhejiang Province, was convened at the New Century Grand Hotel of Hangzhou. Lawyers from those areas gathered together to discuss the topic "Crisis, Challenge, Mission and Value--Financial Crisis and the Legal Industry". Moreover, the Research on Several Issues of the Constitutive Requirements of Unjustified Enrichment wrote in collaboration of Professor Shen Youlun and Zhong Yi, attorney at law, ,both from G•IPRs Runhe Group, was awarded the Second Prize of the Distinguished Paper of the Forum of Lawyers in East China this year.
From Sept. 17 to 19, 2009, Zhong Yi, attorney at law, on behalf of Shanghai Runhe Law Firm, took part in the 30th Session of AVS Working Group in Wu Xi of Jiangsu Province and the Collaboration and Development Forum of AVS International Industrialization of Standard and elaborated the legislative, administrative and judicial status and the trend of development with regard to the domestic patent standardization (see THE FIRST, THE WINNER —— COMMENTS ON THE PATENT STANDARDIZATION STRATEGY UNDER NEW PATENT LAW on this site).
On July 23, 2009, Zhong Yi, attorney at law, met George T. Willingmyre, the President of GTW Associates and the representative of ANSI in Pudong of Shanghai for the discussion and communication of patent issues and policies with regard to the patent standardization.
In July of 2009, Shanghai Runhe Law Firm, represented by Zhong Yi, attorney at law was admitted by Audio Video Coding Standard Working Group of China (AVS Working Group) and become the Observing Members of AVS Working Group. Simultaneously, G•IPRs Runhe Group, based on H.264 Standard and AVS Standard (GB/T 20090.2-2006), launched the termbases establishment of Audio Video Coding Standard.
On July 1, 2009, the Committee of Intellectual Property Rights of Shanghai Bar Association and the Intellectual Property Rights School of Shanghai Tongji University cooperatively held the Seminar on “Advanced Legal Issues of Trademark Law and Geographical Indications”. Zhong Yi, attorney at law, of this site made a keynote speech on the Research of Term Discrimination and Fair Use of Geographical Indications and Trademark.
In June of 2009, the Supreme People's Court promulgated the Interpretation of the Supreme People's Court on Certain Issues Concerning the Application of Law in the Trial of Controversies over the Infringement of Patent Right (Draft) (hereinafter "the Interpretation (draft)") in which Article 20 provides the disclosure obligation when a patent is to be included in a standard, the disclosure obligation of requirements of implementing a license and due obligation during implementing the license with regard to the PIS. The Interpretation also provides the judicial relief methods if such obligations are violated. G•IPRs Runhe Group timely posted the translation of such Interpretation (draft) and established an internal research group of patent standardization in Shanghai Runhe Law Firm. The Group, choosing audio video industry as the breakthrough point, deeply studies how such industry implements and reacts to the strategy of patent standardization.
In April of 2009, G•IPRs Runhe Group preliminarily finished the research of IPR Policies of ISO/IEC, ITU-T, AVS and other standard organizations.
In January of 2009, G•IPRs Runhe Group launched the legal research on issues involved in patent standardization.
